TO CONSIDER proposed consents in the Town of Gravenhurst, pursuant to the provisions of Section 53 
of the Planning Act, 1990, R.S.O. c.P.13, as amended, being

pursuant to the provisions of Section 45 of the Planning Act, R.S.O. 1990, c.P.13, as amended, 
being

AN EXPLANATION of the Purpose and Effect of the proposed consents and minor variance, describing 
the lands to which this Notice applies, a Key Map showing the location of the lands to which the 
consents and variance apply, and a sketch (Schedule) showing the proposed consents and minor 
variance accompany this Notice.

A NOTICE of this Application has been sent to all property owners within 60 metres of the subject 
property and to the appropriate officials and agencies according to Ontario Regs. 197/96 and 200/96 
under the Planning Act. This Notice has been sent to you for your information and does not require 
any response unless you wish to make one.

ADDITIONAL INFORMATION relating to the proposed consents and variance is available from the 
Development Services Department (Planning) located at the Town office at the below address during

ANY PERSON OR AGENCY may attend and provide representation at the hearing and/or make written 
representation prior to the meeting, either in support of, or in opposition to the proposed 
consents and/or variance.

ALTERNATIVELY, ANY PERSON OR AGENCY may also provide verbal comments during the meeting 
electronically using MVI EasyConf Connect Conference System (NOT Zoom), in accordance with Section 
238 of the Municipal Act and the Town’s Procedural By-law. A request to address Committee 
electronically must be completed at www.Gravenhurst.ca/PublicParticipation and submitted prior to 
12:00 pm (Noon) on Thursday, December 12th, 2024.  Please note that the public hearing is taking 
place in person and any issues with electronic participation will not prevent the meeting (and a 
potential decision) from proceeding.

IF A PERSON OR PUBLIC BODY has the ability to appeal the decision of the Gravenhurst Committee of 
Adjustment in respect of the proposed consents to the Ontario Land Tribunal but does not make 
written submission to the Gravenhurst Committee of Adjustment before it gives or refuses to give a 
provisional consent, the Ontario Land Tribunal may dismiss the appeal.

IF YOU WISH TO BE NOTIFIED of the decision of the Gravenhurst Committee of Adjustment in respect of 
the proposed consents and minor variance, you must make a written request to the Gravenhurst 
Committee of Adjustment at 3-5 Pineridge Gate, Gravenhurst, Ontario, P1P 1Z3.

A COPY OF THE DECISION of the Committee will be sent to the applicant and to each person who 
appeared in person or by counsel at the Hearing and to those who have made a written request to the 
Secretary-Treasurer.

EXPLANATION OF THE PURPOSE AND EFFECT
OF THE PROPOSED CONSENTS AND MINOR VARIANCE
APPLICATION Nos. B/18/2024/GR - Mason WALTON and B/19/2024/GR & A/21/2024/GR - Robert BASILIJ & 
Lynda TAYLOR-BASILIJ


Roll Nos. 020-038-06500 (Basilij) & 020-038-06600 (Walton)

Two consent applications have been received for the purpose of a land exchange between two 
properties (Walton & Basilij) in order to address the location of a structure built on the wrong 
property.

The recent completion of a survey determined that Basilij had inadvertently constructed a storage 
shed on the Walton property.  Walton has therefore submitted a consent (severance) application 
(B/18/2024/GR) for the purpose of transferring land (74.0 square metres) surrounding the building 
to Basilij.  To keep the lot areas of both properties the same size as currently exists, Basilij 
has also submitted a consent application (B/19/2024/GR) to transfer an equivalent area of land 
(74.0 square metres) to Walton. No new lots are being created, the lot frontage of both properties 
will remain the same, and the lot areas of both properties will remain the same, but in a different 
configuration, as shown on the attached sketch dated November 29, 2024.

The minor variance request by Basilij is to recognize the location of the building in relation to 
the new lot lines. Specifically, the requested relief is to permit:
•  a storage shed to be setback a minimum of 1.0 metre from the side lot lines, where a 6.0 metre 
setback is required, representing a variance of 5.0 metres.
•  stairs and Deck to be setback a minimum of 2.3 metres from the side lot line, where 6.0 metres 
is required, representing a variance of 2.7 metres.
as shown on the attached schedule dated November 29, 2024.

Both properties are located on Taylor Island on Lake Muskoka. The legal description of the Walton 
property is part of Lot A, Plan 12, formerly in the Township of Muskoka, now in the Town of 
Gravenhurst, in the District Municipality of Muskoka, being Part 1, Plan 35R-14063, and municipally 
known as 7 ISLAND 26LM (Zoning Grid Schedule No. A03).
The legal description of the Basilij property is Part of Lot A, Plan 12 and Block K, Plan 29, 
formerly in the Township of Muskoka, now in the Town of Gravenhurst, in the District Municipality 
of Muskoka, being Part 2, Plan 35R-11177, and municipally known as 97 ISLAND 26LM (Zoning Grid 
Schedule No. A03).

There is no new development proposed as part of these applications.

The subject property is located within the “Waterfront Area” designation of the
Gravenhurst Official Plan, as amended.
