NOTICE OF PUBLIC MEETING

NOTICE OF APPLICATION AND PUBLIC HEARING CONCERNING CONSENT APPLICATIONS, AND NOTICE OF COMPLETE APPLICATION AND PUBLIC MEETING CONCERNING A PROPOSED AMENDMENT TO ZONING BY-LAW 10-04, AS AMENDED

Respecting applications by:

i) Kelly CORDNER (Application No. B/14/2024/GR & ZA 14-2025) for consent & to amend the zoning of lands municipally known as 1070 Riverside Trail, Unit 2

ii) Robert Paul FARRELL & Jennifer Christine FARRELL (Application No. B/15/2024/GR) for consent across lands municipally known as 1070 Riverside Trail, Unit 1

iii) Russell Mark MERGELAS & Jennifer Ann MERGELAS (Application No. B/16/2024/GR) for consent across lands municipally known as 1086 Riverside Trail, Unit 3

TAKE NOTICE THAT complete applications have been accepted under Sections 53 and 34 of the Planning Act, R.S.O.1990, Chapter p. 13, as amended, regarding the above noted property. 

ADDITIONALLY, TAKE NOTICE THAT the Committee of Adjustment of the Corporation of the Town of Gravenhurst will hold a Public Hearing in relation to the Consent applications on

THE PURPOSE of the Public Hearing held at the Committee of Adjustment will be to consider  the proposed Consent applications pursuant to Section 53 of the Planning Act, R.S.O. 1990, Chapter P.13.

The Council of the Corporation of the Town of Gravenhurst will hold a Public Meeting in relation to the Zoning Amendment application on

at 3:00 p.m. at the

Gravenhurst Municipal Offices

(Council Chambers)

THE PURPOSE of the Public Meeting at Council is to consider the proposed amendment to Zoning By-law 10-04 of the Town of Gravenhurst pursuant to the provisions of Section 34 of The Planning Act, R.S.O. 1990, Chapter P.13.

THE FOLLOWING INFORMATION is attached to this notice for your information and review:

  • an explanation of the Purpose and Effect of the Proposed Consent and Zoning Amendment applications;
  • a key map showing the location of the subject property; and
  • a sketch (Schedule).

ANY PERSON OR AGENCY may attend the Public Hearing/Meeting and/or make written or verbal representations either in support of or in opposition to the Proposed Consents and/or By-law.

ALTERNATIVELY, ANY PERSON OR AGENCY may also provide verbal comments during the hearing/meeting electronically using MVI EasyConf Connect Conference System (which is NOT Zoom), in accordance with Section 238 of the Municipal Act and the Town’s Procedural By-law. A request to address Committee/Council electronically must be completed at www.Gravenhurst.ca/PublicParticipation and submitted prior to 12:00pm (noon) on the day before the meeting you wish to attend (Public Hearing and/or Public Meeting).  Please note that the public hearing/meeting is taking place in person and any issues with electronic participation will not prevent the meeting (and a potential decision) from proceeding. 

IF A SPECIFIED PERSON OR PUBLIC BODY does not make oral submissions at a public hearing/meeting or make written submissions to the Secretary Treasurer of the Committee of Adjustment or the Director of Development Services for the Town of Gravenhurst in respect of the proposed Consent and/or By-law before the approval of the Consent application or prior to the proposed Zoning By-law being adopted, the specified person or public body is not entitled to appeal the decision of the Town of Gravenhurst and may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so. 

IF YOU WISH TO BE NOTIFIED of the decision of the Committee of Adjustment in respect of the proposed Consent, you must submit a written request to the Secretary-Treasurer of the Committee of Adjustment at the Town of Gravenhurst.

If you wish to be notified of the decision of the Town of Gravenhurst in respect of the proposed By-law, you must make a written request to Melissa Halford, Director of Development Services at the Town of Gravenhurst.

Purpose and Effect of the Proposed Consent and Zoning By-law

Re:  Application Nos. B/14/15/16/2024/GR & ZA 14-2025

       CORDNER; FARRELL & MERGELAS

       Roll Nos. 020-047-00201; 020-047-00210; 020-047-00200

Applications were received to:

  • create one new waterfront lot (Cordner); 
  • provide for right-of-way access (across Farrell, Mergelas & Cordner Severed Lot);
  • permit a reduced Dwelling setback on the severed Cordner lot (1070 Riverside Trail, Unit 2)

B/14/2024/GR - Cordner

The Cordner property is legally described as Part of Lot N, Concession 20, in the former Township of Wood, now in the Town of Gravenhurst, District Municipality of Muskoka, being Parts 1 & 3, Plan 35R-9034 (Zoning Grid Schedule Nos. H04 & I04).

The Cordner consent application proposes to create one new waterfront lot as shown on the attached sketch:

 

Severed Lot

Retained Lot

Lot Frontage (Severn River)

+/- 74.6 metres

+/- 97.4 metres

Lot Area

+/- 1.9 hectares

+/- 2.1 hectares

Both the proposed severed lot and retained lot are zoned Residential Waterfront (RW-6) subject to Special Provision 108 (S108) and Environmental Protection (EP).  The proposed lot frontages and areas exceed minimum frontage and area zoning requirements for new lots.

B/15/2024/GR – Farrell 

The Farrell property is legally described as Part of Lot N, Concession 20, in the former Township of Wood, now in the Town of Gravenhurst, District Municipality of Muskoka, being Part 2, Plan 35R-19759 (Zoning Grid Schedule Nos. H04 & I04).

The Farrell consent application proposes to grant a right-of-way for access across 1070 Riverside Trail, Unit 1, in favour of the Cordner property.  The proposed right-of-way across an existing driveway will provide legal access to both the proposed severed and retained lots described above (in Section B/14/2024/GR).

B/16/2024/GR – Mergelas

The Mergelas property is legally described as Part of Lot N, Concession 20, in the former Township of Wood, now in the Town of Gravenhurst, District Municipality of Muskoka, being Parts 1 & 3 - 6, Plan 35R-19759 (Zoning Grid Schedule Nos. H04 & I04).

The Mergelas consent application proposes to grant a right-of-way for access across 1086 Riverside Trail, Unit 3, in favour of the Cordner property.  The proposed right-of-way across an existing driveway will provide legal access to both the proposed severed and retained lots described above (in Section B/14/2024/GR).

 As a result of the three proposed consent applications (B14/15/16/2024/GR), one (1) new lot will be created, and a legal right-of-way for access will be granted.

ZA 14-2025 - Cordner

A Zoning Amendment application has been received for the proposed severed Cordner lot. 

The applicant is proposing to construct a Dwelling that is setback a minimum of 16.3 metres from the water (Severn River), as shown on the attached site plan.  As a 30.0 metre setback is required for a new Dwelling, the proposed 16.3 metre setback requires a site-specific amendment to the Zoning By-law.

Please note that the proposed Dwelling setback can be dealt with separately from the consent applications described above, as they are not directly related. 

All of the subject properties are located within the “Waterfront Area” designation of the Town of Gravenhurst Official Plan, as amended.
